Before being allowed to join us on this special day, the attached LIABILITY RELEASE (WAIVER) must be read, understood and agreed to by a parent or legal guardian.  

On behalf of myself, my children, children in my care, and any other persons on property and in or around the Game Bus and/or Gamer Arkade participating in activities with Gamez2Go, I acknowledge and agree to the terms and conditions of this waiver as identified below: 

1. I, and the children in my care who will participate in any Gamez2Go activities are physically, mentally and emotionally fit to participate in such activities.

2. There are risks, both known and unknown, in playing video games and entering & exiting our equipment and location. This includes, but is not limited to physical injury, emotional injury and distress. I understand that Mature and Teen rated titles may be played during the experience and that my child/children may be exposed to this content. I am fully responsible for making all parties (essentially including, but not limited to the host parent and Gamez2Go personnel) aware of any special needs or allergies my child/children may have. The risk of serious injury from participating in Gamez2Go activities, although minimal, does exist as it does in all play and amusement activities. 

3.  I will inform all participants to follow all rules of participation as indicated by the game coach and will trust their judgment in their safe participation. I understand the Gamez2Go staff does not provide a sitting service and is not responsible for the actions of any participants. 

4. I understand that Gamez2Go strives to provide a sanitary environment for all guests using our equipment. If a guest is suspected or known to be spreading malignant germs, said guest may be restricted from boarding or operating any Gamez2Go equipment in order to maintain a sanitary environment and prevent contamination.

5. I hereby consent to the recording of statements, photographs, and/or audio or video recordings taken of my child/children at this Gamez2Go event by Gamez2Go personnel. All statements, photographs, and/or audio or video recordings taken of “the Minor(s)” or me, by Gamez2Go, may be used by Gamez2Go for promotional, commercial or other purposes as determined by Gamez2Go anywhere in the world in its sole discretion. Neither “the Minor(s)” nor I shall have any right to control the use or publication by Gamez2Go of the statements, photographs, and/or audio or video recordings. On behalf of “the Minor(s)” and myself, all statements, photographs, and/or audio/video recordings taken of “the Minor(s)”or me by Gamez2Go or its contractors, shall be the sole property of Gamez2Go. Neither the Minor nor I shall receive any compensation in connection with use of these statements, photographs, and/or audio or video recordings for promotional, commercial or other purposes. I hereby release, waive and discharge any claims of any kind or nature arising out of or relating to the use of the statements, photographs, and/or audio or video recordings against Gamez2Go or any person or firm authorized by Gamez2Go to publish said materials (“Publisher”). Such release, waiver and discharge shall also extend to all affiliated companies, shareholders, directors, officers, employees, agents and assigns of Gamez2Go and any Publisher.

6. I, on behalf of myself, my children, my family members, children in my care, my heirs and my guests, knowingly and freely assume all risks of injury and agree to hold harmless Gamez2Go, its owners, shareholders, managers, agents and employees with respect to any claims, demands, causes or rights of action, even if arising from the actions, acts of omission or negligence of said entities or individuals. 

I HAVE READ THIS WAIVER OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS FOR MYSELF AND THOSE FOR WHOM I HAVE ASSUMED RESPONSIBILITY. MY BOOKING WITH GAMEZ2GO INDICATES THAT I FREELY AND VOLUNTARILY AGREE TO THESE TERMS. 

RENTAL AGREEMENT

RENTAL DAMAGE POLICY:
The rental equipment has been received in good, working condition and will be returned in the same condition.  Customer agrees to pay in full, the replacement cost, including labor for all damages to rental equipment. This includes if any equipment is lost, stolen, or damaged beyond repair by any persons on customer's property, designated location of event, and in or around the Game Bus and/or Gamer Arkade.

DEPOSIT/REFUND/CANCELLATION POLICY:
A valid credit card or debit card is required to reserve your reservation. Since the Game Bus and Gamer Arkade does get reserved for your date and time not allowing others to book it, we do have to charge for cancellations. There will be a cancellation fee equal to 50% of your deposit for all parties or events canceled after payment is received. NO REFUND in the event of a reservation being canceled within 21 days of your event. We will make every effort to postpone your event, with no penalty, to another date should cancellation be needed.

PRIVACY POLICY:
Gamez2Go LLC is committed to protecting your privacy. We use the information we collect to make bookings as simple as possible and to enhance your overall experience. We do not sell, trade, or rent your personal information to others.

TRAVEL SURCHARGE FOR GAME BUS:
Our primary service area is a 20-mile radius from Bettendorf, IA (Zip 52722) We also service a “secondary” area outside our primary area, but must add a fuel surcharge fee when we travel to the secondary area. The fuel surcharge fee is $3 for each mile outside of our primary service area.

LIABILITY RELEASE (WAIVER):
Parents or party host is asked to agree to a liability release form that they agree to accept full responsibility for any accidents or damages on their own property and/or at Gamer Arkade for all players/guests they invited. Since we would not know who was invited, that extends to any one on the homeowners property and/or at Gamer Arkade during the event.

BAD WEATHER FOR THE GAME BUS:
The Gamez2Go LLC bus was designed for all types of weather conditions. The theater is insulated and climate controlled with heat and air conditioning. There may be occasions when the weather does not want to cooperate with your scheduled party. In the event of severe weather (lightning, very high winds, flooding and/or extremely heavy rains, snow or ice) we may (and reserve the right to) reschedule your service to guarantee the safety of you, your guests, our staff and equipment. If the threat of these storms threatens your party and you are aware in advance (pending or anticipated snow storm or other strong weather event) please contact us to begin the rescheduling.

SUPERVISED CHILDREN:
Gamez2Go LLC does require a parent or responsible adult to be present at all times. Guests under the age of 18 require a parent or guardian or other designated person for their care, be on property at all times.

ALCOHOL/DRUGS:
You may serve alcohol at your event or party; however, we reserve the right to refuse, cancel or cut short any party or booking when alcohol is being served. Drugs of any sort will not be tolerated in or around the Gamez2Go LLC equipment. Any observed use of illegal narcotics or legal narcotics used in an illegal manner will result in the termination of the party immediately.

DAMAGE/INJURY:
Gamez2Go LLC or any of its employees will not be responsible for any damage to property resulting from a request by the client to position the bus in a specific location. This includes both above ground and below ground property/equipment damage. Additionally, Gamez2Go LLC reserves the right to charge the client’s credit card for damages to the bus or equipment resulting from the careless or willful damage of same by clients guests. Gamez2Go LLC or its employees assume no responsibility for any injuries sustained on the clients property or their designated location. All liability for damages or injuries are the sole responsibility of the client and/or host.

FOOD:
Gamez2Go LLC does not allow any food into the video game theater. Please have your guests consume any food outside of the bus prior to entering. Guests are permitted to bring their own food and drink into Gamer Arkade. We ask that the host for the party uses good judgement when choosing food options and keeps our equipment clean. Should the equipment be left unclean, a cleaning fee may result.

PICTURES:
While your party is in effect, the Game Coach may take pictures and/or video of the party from inside the bus. You will then be able to view these pictures on Gamez2Go LLC Facebook Fan Page or website and copy them to your files. If you do not want our Game Coach taking these pictures or posting them on the Fan Page or website, please notify us via Email prior to the party. This is a service we provide to our guests so they can be sure to capture their party as it happens.

INVITATIONS:
We will email a pdf, personalized copy of our invitations to the email address we have on file for you.  You can print these out for your guests.  This email will be sent out within 48 hours of deposit being received.

TIPS:
The Game Coach is there to make sure that your group is making the most of our high-tech fun. He/She tutors, inspires and entertains. Tipping for good service is a great idea, but not required.

OUR BUS:
When the bus pulls up, we will try to park in the most level & flat area or logical spot to accommodate your party. Sometimes, we park in your neighborhood street, so you might want to let your neighbors know (in case they may object) or let us know if you have a preferred spot for us. We might also have to block a driveway.

**Please keep in mind that our Game Coach will not park anywhere that may cause a danger to persons, property or equipment. Our bus is very long and we will need a minimum of 50 feet of space to park. 

GAMER ARKADE:
The Arkade is reserved much like an Airbnb in that the host will receive a code to unlock the door that will be good for the duration of the party. A Game Coach will not be present during your event, however, should you need assistance, please call or text us at (563) 209-9193. All consoles at Gamer Arkade have games pre-loaded on them, so switching out physical discs is not necessary. We ask that you leave the Arkade in the same condition as it was when you arrived including resetting controllers back to their locations and taking any food and/or drinks you brought, with you. Please account for all controllers, remotes, and equipment before leaving the premises. Failure to do this, may result in additional fees for any missing equipment and those fees will be charged directly to the card used to make your reservation.

VIDEO GAME RATINGS:
Gamez2Go LLC will not play any “M” rated or higher game in the video game theater without authorization from the client prior to the party/event or adult approval at the time of the event. If you have any special requests or games that you would like us to have at your event, please let us know prior.
